LUDINO responds to law-enforcement and other valid legal requests for user data in accordance with its terms, privacy policy, and applicable law.
Types of requests
01
Data requests
Except for emergencies, requests must be served through valid legal process. Depending on the information sought, this may include a subpoena, court order, warrant, Mutual Legal Assistance Treaty request, or another process recognized by applicable law.
02
Emergency requests
We may disclose limited information when we believe in good faith that delay could create a real and imminent danger of death, serious bodily harm, harm to a minor, or another emergency. Requests must come from a law-enforcement officer and be signed under penalty of perjury.
03
Preservation requests
For a valid request connected to an official investigation or proceeding, we may preserve existing user data for 30 days or a longer period while awaiting formal legal process, as permitted by law.
Required request information
Requests must be on official agency letterhead and include the legal process, agency and agent names, badge or identification number, official email, direct telephone number, mailing address, requested response date, the specific user's LUDINO ID or UID, and a precise description of the information requested.
We may reject requests that are incomplete, invalid, overly broad, vague, unclear, or unduly burdensome. If a request is not in English, an English translation is encouraged. We generally disclose no more information than legally necessary.
User notice and consent
We generally notify users before disclosing their information unless notice is prohibited by valid legal process or law, could create a risk of injury or death, or involves potential harm to minors. When a nondisclosure order expires or is overturned, we may notify the affected user. A consenting user should ordinarily be directed to obtain available account information through their own account.
Where to serve a request
As set out in section 11 of the User Agreement, all requests for information or documents related to potential, anticipated or current legal proceedings, investigations or disputes, or for third party user information, must be made using the appropriate level of legal process and properly served via Yaro Technology LLC.
